Exclusive Driver – Terms & Conditions

Exclusive Driver Services Limited (“Exclusive Driver”, “we”, “our”, “us”) provides bespoke chauffeur, private transfers, and curated touring services throughout New Zealand. By confirming a booking, you (“the Client”, “you”) agree to the following Terms & Conditions.

This document should be read in conjunction with Exclusive Driver Services Limited, Risk Disclosure, Participant Responsibilities & Limitation of Liability document.

1. Definitions

Exclusive Driver / We / Us: Exclusive Driver Limited
Client / You: The person or organisation making the booking
Services: Chauffeur-driven transport of passengers, luggage, and curated touring services
Booking: A reservation confirmed once payment has been received
Excursions:  Activities arranged with a third-party provider such as boat cruises and wine tasting.

2. Bookings & Confirmation

  • Bookings may be made via our website, email, WhatsApp, or telephone.

  • All quotes are subject to availability until full payment is received.

  • A booking is confirmed only once payment has been received.

  • Driver details will be provided prior to service commencement.

  • If booking on behalf of others, you accept responsibility for their compliance with these Terms.

  • Exclusive Driver reserves the right to correct any clerical or pricing errors.

3. Pricing, Quotes & Payment

  • All prices are in NZD and include GST unless stated otherwise.

  • Quotes are valid at the time issued and may change, particularly where third-party suppliers are involved (accommodation, ferries, excursions).

  • International card payments may incur a processing fee.

  • If payment is delayed or dishonoured, Exclusive Driver may cancel the booking and retain any payments made.

Inclusions

  • Professional driver and vehicle

  • Driver meals, accommodation, and relocations, where required

  • Curated tour components listed in the itinerary

Exclusions

  • Client meals (unless specified)

  • Client accommodation (unless included in a tour package)

  • Excursion tickets and activities unless stated

  • Personal expenses and any items not explicitly included

4. Deposits & Balance Payments

Transfers

  • 25% deposit for bookings made more than 7 days in advance

  • Full payment required at least 24 hours prior for bookings within 7 days

  • Eligible for refunds per the Cancellation Policy

  • No administration fee applies

Private Day Tours

  • 25% deposit at booking

  • Balance due 10 days prior to tour commencement

  • Bookings within 10 days require full payment

  • All quotes remain subject to availability until deposit is received

Multi-Day Journeys and Curated Custom Tours

  • 30% deposit at booking

  • Balance due 30 days prior to tour commencement

  • Third-party suppliers may require non-refundable prepayments

  • All quotes remain subject to availability until deposit is received

Administration Fee

Where a refund is permitted, a NZD $100 non-refundable administration fee applies

Design Fee for Curated Custom tours

Where a custom tour and bespoke itinerary is requested, a NZD $500 non-refundable design fee applies in consideration of the time, expertise and attention to specific requirements.  This shall be payable whether you proceed with the tour or not.  Should you go on to accept the quote for the tour, the Design Fee will be deducted from the total price of the tour.

5. Passengers & Baggage

  • Passenger numbers and luggage details must be disclosed at the time of booking.

  • Excess luggage or additional passengers may require additional vehicles at the Client’s cost.

  • The Client is responsible for any damage caused by passengers.

Prohibited Items (unless agreed in writing)

  • Dangerous, hazardous goods or illegal goods

  • Animals

  • High-value items (jewellery, bullion, art, antiques)

  • Refrigerated or temperature-sensitive goods, unless agreed

6. Safety, Conduct & Vehicle Etiquette

For the comfort and safety of all passengers and drivers:

  • Seatbelts must always be worn

  • No alcohol, drugs, smoking, or vaping in vehicles

  • Food permitted at the driver’s discretion

  • Abusive, unsafe, or inappropriate behaviour may result in immediate termination of services without refund

  • To comply with health and safety requirements and ensure our drivers remain well rested, guests may be required to organise alternative transport for evening dinner drop-offs and pick-ups at their own expense, unless otherwise agreed in advance.

Cleaning Fee: NZD $300 applies for spills, or soiling requiring professional cleaning.

7. Pickup, Delays & No-Shows

General Waiting Time for Transfers

After 30 minutes with no contact, the booking may be marked a no-show

Airports

  • Domestic flights: 45 minutes waiting time included

  • International flights: 90 minutes waiting time included

Extended Delays

If delays impact scheduling or legal driver-hour limits, Exclusive Driver may:

  • Reschedule at additional cost

  • Arrange an alternative driver where possible

Delays Outside the Client’s Control

We recognise that some delays are unavoidable (airline delays, customs, luggage delays, medical events, road closures). Where communication is maintained, we will act reasonably and do our best to accommodate you.
Delay charges may still apply where the driver is required to remain on standby.

No-Shows

A no-show occurs if the Client fails to meet the driver within 30 minutes of the scheduled time with no communication.  No-shows are non-refundable.

8. Cancellation & Refund Policy

All cancellations must be submitted in writing and confirmed by Exclusive Driver.

Transfers

  • 24+ hours: Full refund

  • Within 24 hours: Non-refundable (unless due to flight cancellation)

  • No administration fee

Private Day Tours

  • 10 days: Refund minus NZD $100 admin fee

  • Within 10 days: Non-refundable

  • Supplier cancellation terms may override these terms

Multi-Day Journeys

  • 30 days: Refund minus NZD $100 admin fee and non-refundable supplier costs

  • Within 30 days: Non-refundable

  • Supplier cancellation terms may override these terms

9. Changes & Rescheduling

Exclusive Driver will make reasonable efforts to accommodate changes caused by airlines, ferries, or suppliers. Changes requested within the cancellation period may be treated as cancellations.

10. Refund Processing

Refunds will be processed within 10 business days to the original payment method.

11. Force Majeure

Exclusive Driver is not liable for delays or non-performance due to events beyond reasonable control, including severe weather, natural disasters, pandemics, government restrictions, accidents, or infrastructure failures. Unused services may be refunded, at the sole discretion of Exclusive Driver, minus non-recoverable costs.

12. Travel Insurance & ACC

  • Comprehensive travel insurance is strongly recommended to cover any loss you may incur due to booking cancellations. 

  • ACC covers personal injury in New Zealand but does not cover travel delays, cancellations, or losses.

13. Travel Documentation

The Client is responsible for ensuring all passengers hold valid passports, visas, and travel documentation for their journey.

14. Itineraries

Final itineraries are issued once full payment is received.
Any errors must be reported at least five working days prior to travel.

15. Liability

  • Goods are carried under limited carrier’s risk in accordance with the Carriage of Goods Act 2017.

  • Loss or damage must be reported within seven days.

  • Liability is limited to the amount paid for the services, excluding third-party Charges.

  • Exclusive Driver is not liable for indirect or consequential losses or the actions of third-party suppliers.

  • Nothing in these Terms limits rights under the Consumer Guarantees Act 1993 for consumer bookings.

16. Special Requirements

Please advise at booking if you require:

  • Child seats

  • Oversized luggage (golf bags, surfboards, instruments)

  • Mobility or accessibility assistance

These are subject to availability and prior arrangement.

17. Assignment & Subcontracting

Bookings may not be transferred without written consent.
Exclusive Driver may subcontract services to licensed, vetted providers.
Where necessary, an affiliate driver or vehicle may be provided at no additional cost, with services delivered at the originally quoted price.

18. Dispute Resolution

Any dispute will first be addressed through negotiation or mediation before legal proceedings.

19. Privacy & Data Use

We collect only the information required to deliver our services.
Personal Information may be shared with suppliers as necessary to complete their services.
Clients may request access to or correction of personal data.

20. Amendments

These Terms may be updated periodically.
The latest version published on our website applies to all new bookings.

21. Intellectual Property

All Exclusive Driver branding, itineraries, and materials are protected.
They may not be copied or used commercially without written permission.

22. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

23. Governing Law

These Terms are governed by the laws of New Zealand.
The Client submits to the exclusive jurisdiction of New Zealand courts.

Service Standard

Exclusive Driver delivers discreet, professional chauffeur services with a commitment to comfort, safety, and seamless travel. Vehicles are meticulously maintained, and drivers are experienced, licensed, and trained to meet our exacting standards.
